Welcome to NovelMe. These Terms of Use ("Terms") govern your access to and use of the NovelMe mobile application, websites, products, features, content, and related services (collectively, the "Service") provided by Chengdu Xinpengda Technology Co., Ltd. ("NovelMe," "we," "us," or "our").
By accessing or using the Service, you agree to these Terms. If you do not agree to these Terms, please do not use the Service.
1. Eligibility
NovelMe is intended only for users who are 18 years of age or older. By using the Service, you confirm that you are at least 18 years old and have the legal capacity to agree to these Terms.
Users under 18 may not use NovelMe. We do not knowingly provide the Service to users under 18. If we learn that a user under 18 has used the Service, we will terminate access and delete the relevant information.
2. Description of the Service
NovelMe is an AI-powered storytelling app that helps users turn personal memories, emotional experiences, interview responses, written input, and voice input into private story drafts, story previews, novel-style content, character information, covers, and related creative materials.
NovelMe is designed for creative writing and personal storytelling. NovelMe is not a medical, mental health, counseling, therapy, crisis support, legal, financial, or other professional advice service.
3. Guest Use and Account Login
You may use certain parts of NovelMe as a guest. We assign a guest identifier to support guest access, save progress, record entitlements, manage purchase benefits, track orders, prevent fraud, and improve the Service.
NovelMe supports Sign in with Apple for account login. If NovelMe launches an Android version in the future, Android login and purchases will be handled through Google Play or other login and payment methods available in that version.
When you sign in, your guest activity, stories, drafts, purchase records, subscription status, credit balance, and other account-related information may be linked to your NovelMe account.
You are responsible for maintaining access to your Apple account, device, and NovelMe account. If you lose access to your Apple account, device, or linked NovelMe account, some features, entitlements, or content may not be recoverable.
4. User Content
"User Content" means any content you submit, upload, speak, write, edit, confirm, or otherwise provide through the Service, including:
Text input;
Interview responses;
Voice recordings;
Speech-to-text transcripts;
Personal stories or memories;
Character information;
Relationship, plot, emotion, and writing intent information;
Titles, tags, notes, and edits;
Feedback and suggestions.
You retain the rights you have in your User Content.
To provide the Service, you grant NovelMe a limited, worldwide, non-exclusive license to process, store, reproduce, modify, display, and use your User Content as reasonably necessary to:
Provide the Service;
Generate story drafts, story previews, covers, and related creative content;
Save, display, download, export, and restore your content for you;
Maintain account, guest, purchase, subscription, and credit balance features;
Perform content safety review, abuse prevention, troubleshooting, service security, and product quality improvement;
Comply with legal obligations and enforce these Terms.
Unless we obtain your separate and explicit consent, we do not use your private stories, interview content, voice recordings, transcripts, drafts, or generated content to train NovelMe's own AI models or third-party AI models.
Your stories, interviews, drafts, voice recordings, and generated content are private by default. Unless you actively use sharing, publishing, exporting, or public features currently or later provided by NovelMe, or you independently copy, save, or publish content to a third-party platform, we will not publicly display your content to other users.
If you choose to share, publish, export, or make content public, you are responsible for ensuring that the content does not infringe or violate another person's privacy, reputation, copyright, publicity rights, trademark rights, or other legal rights.
5. AI-Generated Content
NovelMe uses AI technologies to generate story previews, story drafts, novel-style text, summaries, titles, character information, covers, and related creative materials based on your input.
AI-generated content may be inaccurate, incomplete, emotionally imperfect, unexpected, or similar to content generated for other users. You are responsible for reviewing, editing, and deciding how to use AI-generated content.
To the extent permitted by law, you may save, edit, download, export, and share AI-generated content generated based on your input for personal and non-commercial purposes.
NovelMe does not guarantee that AI-generated content is original, copyrightable, exclusive, non-infringing, accurate, emotionally suitable, or appropriate for commercial publication, commercial distribution, adaptation, or other commercial use.
Any commercial use, publication, distribution, adaptation, or external use of AI-generated content is your own responsibility. You are responsible for obtaining any rights, permissions, reviews, or clearances required for such use.
6. Acceptable Use
You agree not to use the Service to create, submit, request, generate, share, or distribute content that:
Violates any law or regulation;
Infringes or misuses another person's intellectual property, privacy, publicity, reputation, or other rights;
Contains real personal information about others without permission, such as phone numbers, addresses, workplaces, schools, social media accounts, private photos, or identifying details;
Defames, harasses, threatens, stalks, doxxes, or targets another person;
Encourages, instructs, or facilitates self-harm, suicide, violence, abuse, exploitation, or illegal acts;
Contains sexual content involving minors or any exploitation of minors;
Contains hateful, discriminatory, or abusive content targeting protected characteristics;
Is fraudulent, deceptive, malicious, harmful, or intended to manipulate others;
Attempts to bypass safety systems, usage limits, payment systems, subscription systems, or content restrictions;
Interferes with, disrupts, reverse engineers, scrapes, or attacks the Service.
If we determine that content violates these Terms, our policies, or applicable law, we may refuse to generate it, stop processing it, remove it, restrict access to it, or review it.
We use automated systems to conduct content safety reviews. In limited cases involving safety, technical issues, policy violations, disputes, legal requests, support requests, or service security, authorized personnel may manually review relevant content. Access is limited by permission controls, access logs, and the principle of minimum necessary access.
7. Emotional and Safety Notice
NovelMe may help you reflect on emotional experiences and turn them into stories. However, NovelMe is not a crisis service, mental health provider, therapist, counselor, or emergency service.
If you may harm yourself or someone else, or if you are in immediate danger, please contact emergency services or a qualified professional in your area. In the United States, you may call or text 988 for the Suicide & Crisis Lifeline.
8. Purchases, Memberships, Subscriptions, and credit packs
NovelMe offers paid features, memberships, auto-renewable subscriptions, and credit packs through Apple App Store. If NovelMe launches an Android version in the future, Android purchases will be processed through Google Play.
Paid products include:
Weekly Subscription: USD $6.99, including 50,000 Writing Credits during the applicable weekly subscription period;
Weekly Subscription Plus: USD $9.99, including 69,900 Writing Credits during the applicable weekly subscription period;
Annual Subscription: USD $99.00, including 1,200,000 Writing Credits during the applicable annual subscription period;
Credit Pack: USD $9.99, including 69,900 Writing Credits;
Credit Pack: USD $49.00, including 490,000 Writing Credits;
Credit Pack: USD $99.00, including 1,200,000 Writing Credits.
The final price, billing period, taxes, currency display, and purchase confirmation are shown on the in-app purchase page and the applicable app store payment confirmation page. If the app store price display conflicts with the text above, the app store payment confirmation page controls the actual charge.
Purchases are processed by Apple App Store or, for a future Android version, Google Play. We do not collect or store your payment card information.
9. Auto-Renewable Subscriptions
Subscription products renew automatically unless you cancel the subscription through your Apple ID, Google Play, or applicable app store subscription management page before the end of the current subscription period.
After cancellation, you may continue to use the applicable subscription benefits until the end of the current paid subscription period. After that period ends, subscription benefits stop unless you subscribe again.
The two weekly subscription products are in the same subscription group. You can have only one active subscription in that subscription group at a time. The effective time of upgrades, downgrades, changes, cancellations, renewals, and billing is governed by Apple App Store or, for a future Android version, Google Play rules.
If separate subscription groups or products are offered in the future and the app store allows more than one active subscription, the corresponding benefits will be issued according to the product rules shown on the purchase page.
Deleting your NovelMe account does not automatically cancel your Apple or Google Play subscription. You must cancel your subscription through the applicable app store account settings to avoid future charges.
10. credit allowances and Deduction Rules
For NovelMe, “Writing Credits” are usage units for AI generation. In English and similar languages, each individual word, space, punctuation mark, symbol, or line break counts as two Writing Credits. Writing Credits are not the same as standard English word count.
For example, “I miss you” counts as 10 Writing Credits: “I” counts as 2, each space counts as 2, “miss” counts as 2, and “you” counts as 2. “I miss you.” counts as 12 Writing Credits because the period also counts as 2.
Subscriptions include credit allowances that may be used only during the applicable subscription period. Unused subscription credit allowances expire when the subscription period ends, the subscription is canceled at the end of the paid period, or the subscription otherwise becomes inactive.
Separately purchased credit packs are independent credit allowances. credit packs are valid for 5 years from the date of purchase, unless they are used, refunded, revoked due to fraud or chargeback, or a longer period is required by applicable law.
If your account has both subscription-period credit allowances and separately purchased Credit Pack allowances, the system uses subscription-period credit allowances first, and then separately purchased Credit Pack allowances.
Each AI generation, regeneration, expansion, rewriting, or editing generation request is treated as a separate generation request and consumes the applicable credit allowance when content is successfully generated and displayed to you.
If content is successfully generated and displayed to you, the generation consumes credit allowance even if you are not satisfied with the result, choose to delete it, regenerate it, or continue editing it.
If a system error, network error, or generation failure results in no usable output, we do not deduct the corresponding credit allowance.
11. Restore Purchases
You may use the restore purchases feature in the app to restore restorable benefits purchased through Apple App Store or, for a future Android version, Google Play.
Subscription benefits are restored through the applicable app store account. Separately purchased credit packs must be linked to your NovelMe account before they can be restored or displayed.
The result of restore purchases depends on the app store account you use, your NovelMe account binding status, order status, refund status, subscription status, and app store rules.
12. Refunds
Refunds for purchases made through Apple App Store, Google Play, or other app stores are handled by the applicable app store according to its policies. NovelMe does not control app store refund decisions.
If a purchase fails, is refunded, reversed, canceled, charged back, or found to be fraudulent, we may revoke or adjust the related benefits, membership status, credit balance, or content access.
13. Account Deletion
You may request account deletion through the in-app account deletion feature.
After your deletion request is confirmed, we delete or anonymize your account information, stories, interviews, drafts, voice recordings, speech-to-text transcripts, generated content, and related content data within 25 days.
The following records are retained where required for legal, accounting, fraud prevention, dispute resolution, refund handling, app store compliance, service security, or other compliance purposes:
Purchase and transaction records;
Subscription verification records;
Refund or dispute records;
Risk control and anti-fraud records;
Records that applicable law requires us to retain.
Before deletion is completed, you may cancel the deletion request by signing in again with the same account.
After deletion is completed, deleted or anonymized stories, interviews, drafts, voice recordings, transcripts, and generated content cannot be recovered. Even if you later restore an active subscription through an app store account, only valid subscription or purchase entitlements can be restored. Deleted or anonymized content cannot be recovered.
Deleting your NovelMe account does not cancel Apple App Store, Google Play, or other app store subscriptions. To avoid future charges, you must cancel your subscription through the applicable app store account subscription settings.
14. Content Retention and Backup
Completed story content is retained while your account remains active, unless you delete your account, violate these Terms, we are legally required to delete it, or a specific in-app feature clearly states otherwise.
Original voice files, speech-to-text transcripts, intermediate interview records, AI generation process data, temporary drafts, and long-inactive story materials are deleted, cleared, or anonymized after 6 months of long-term inactivity, story completion, or discontinuation.
Backup copies are retained for up to 1 year. Backup data containing stories, interviews, voice recordings, or transcripts is deleted, overwritten, or anonymized within the backup cycle.
We make reasonable efforts to preserve completed story content during the active account period, but you should use the app's download or export features to save important content yourself.
15. Feedback
If you submit feedback, ideas, suggestions, or comments to us, you agree that we may use them to improve NovelMe without compensation or obligation to you.
In-app feedback does not require you to provide contact information. When you submit in-app feedback, we automatically receive app version, device information, current page information, error information, and log information to locate and resolve the issue.
16. Notifications
With your device permission, we send push notifications, including story generation completion reminders, service notices, product updates, activities, discounts, and promotional offers.
NovelMe currently does not support separately disabling marketing push notifications inside the app. You can turn off NovelMe notifications in your device settings.
17. Service Changes and Availability
We may modify, suspend, or discontinue any part of the Service. We may also update AI models, prompts, safety systems, pricing, product features, usage limits, content types, or purchase products.
If a change materially affects your paid rights or legal rights, we will provide notice through the app, purchase page, app store listing, or other reasonable method as required by applicable law.
We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
18. Termination
We may suspend or terminate your access to the Service if we determine that you have violated these Terms, misused the Service, created risk for NovelMe or others, failed to pay required charges, committed fraud, abused subscriptions or credit packs, or violated applicable law.
You may stop using the Service at any time.
19. Intellectual Property
You retain the rights you have in the personal experiences, interview content, story materials, and edits you submit to NovelMe. NovelMe does not claim ownership of your User Content or the story text generated for you based on your User Content.
To provide the Service, you authorize NovelMe to process, store, display, modify, and use your content as reasonably necessary for generation, saving, editing, syncing, review, download, export, troubleshooting, safety, and service improvement.
The NovelMe application, software, interface, designs, trademarks, logos, prompt systems, model configurations, workflows, product logic, and related technical capabilities are owned by NovelMe or its licensors.
You may not copy, modify, distribute, sell, reverse engineer, scrape, or create derivative services based on NovelMe's software, interface, prompts, systems, or technical capabilities except as permitted by law.
20. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, share, retain, transfer, protect, and delete information.
Please review the Privacy Policy before using the Service.
21. Disclaimers
The Service is provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, NovelMe disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.
We do not guarantee that:
AI-generated content will meet your expectations;
Generated stories will be accurate, unique, complete, original, copyrightable, or emotionally suitable;
The Service will be uninterrupted, secure, or error-free;
Any content will be preserved forever;
Any generated content will be suitable for publication, commercial use, adaptation, or external distribution.
22. Limitation of Liability
To the fullest extent permitted by law, NovelMe and its affiliates, officers, employees, contractors, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of content, loss of profits, emotional distress, service interruption, or loss of business opportunity.
If applicable law does not allow liability to be fully excluded, our total liability will be limited to the greater of the amount you paid to NovelMe for the Service in the one month before the event giving rise to the claim, or USD $50.
23. Changes to These Terms
We may update these Terms based on product features, legal requirements, platform rules, or business changes. When we make changes, we will update the effective date.
If a change materially affects your rights, we will provide notice through in-app notices, pop-ups, announcements, purchase pages, app store listings, or other reasonable methods. Where consent is required by law, we will obtain your consent before the change takes effect.
Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
